Terms and conditions of use
The Site, accessible via the following url: https://participons.imt.fr is operated in compliance with French law. Use of this site is governed by the present terms and conditions. By using the site, you acknowledge that you have read and accepted these conditions. They may be modified at any time and without prior notice by Institut Mines-Télécom, which may not be held liable in any way for misuse of the service.
ARTICLE 1 - DEFINITIONS
For the purposes of interpreting these General Terms and Conditions of Use for the "participons.imt.fr" platform, the terms used below, in the plural or singular, are defined as follows:
- Platform: refers to the dematerialized tool participons.imt.fr, accessible to all via the Site and through which Contributors may contribute.
- Contributor: refers to any person who identifies themselves on the Platform via an SSO connection (login and password for Institut Mines-Télécom students and staff) or after creating a local account. Login details are strictly personal and confidential. Contributors use the Platform to access content, publish a proposal or comment on a proposal accessible on the Platform.
- Contribution: means any proposal or opinion on a proposal drafted by a Contributor and liable to be modified.
- Participons.imt.fr: means the online Platform accessible to all and grouping together the Proposals of Contributors and the Publisher.
- Content: means any content published by a Contributor on the Platform, and in particular any proposal or opinion on a proposal.
- Account: refers to a Contributor's personal space on the https://participons.imt.fr website, enabling him/her to access specific content and contribute to the creation of Content on the Platform.
- Visitor: refers to any person accessing and/or using the Site without prior identification.
ARTICLE 2 - PURPOSE
The purpose of these GCU is to define the terms and conditions of use of the Participation Platform offered by the Publisher and accessible to all.
The Publisher has set up a participatory Platform, called Participons.imt.fr, enabling Contributors to share proposals and ideas, issue opinions or comments, support and vote on existing proposals, answer questionnaires and interact with other Contributors.
ARTICLE 3 - SCOPE OF APPLICATION
The GTC of participons.imt.fr apply, without restriction or reservation, to all services offered on the Platform.
The GCU of participons.imt.fr are supplemented, where applicable, by special conditions applicable to certain services offered within the various sections of the Site.
The GCU of participons.imt.fr take effect from the date of their publication on the Site and remain in force until they are modified in whole or in part by the Publisher.
ARTICLE 4 - CONTRIBUTION CREATION PROCESS
4.1 Creating a Contribution
Only Contributors may participate. This means that the creation of a Contribution or its modification implies (i) identification on the platform and (ii) full and unreserved acceptance of the Site's GCU.
The information submitted by the Contributor when creating his/her Account and enabling him/her to be identified is accurate and sincere.
4.2 Forms of Contribution
To allow everyone to express themselves, the size of a proposal is limited.
Each Contributor may choose to have his or her Proposal published under his or her name or under a pseudonym.
Use of a pseudonym implies compliance with the following rules:
It is forbidden to usurp the identity of another natural or legal person, or to choose a pseudonym likely to create confusion or to deride a natural or legal person.
The use of a pseudonym does not exonerate its user from either criminal or civil liability that may result from the content published, even when it has been removed at their initiative and/or that of the Publisher.
The Contributor of a Contribution must ensure that its text complies with the laws and regulations in force, with public order, with these GCU as well as with the Platform's Participation Charter accessible from the footer of each page of the Site.
The Contributor hereby accepts that its Contributions on the Platform may be [commented on, enriched and modified by the community of Contributors, subject to its acceptance, and] consulted by all Visitors to the Platform.
4.3 Referencing Contributions
All Contributions published on the Platform are likely to be referenced on a search engine and, therefore, to be consulted by an external public which will have access to the public data defined by the Contributor when opening his Account.
ARTICLE 5 - CONTENT MODERATION
It is the responsibility of Contributors to ensure that their Content does not infringe the rights and freedoms of others and complies with the regulations in force.
The publication of Content provided by the Contributor is subject to a posteriori moderation by the Editor, who reserves the right to withdraw/delete any Content that does not comply with laws and regulations, these GCU or the Platform's Participation Charter accessible from the footer of each page of the Site.
The Contributor and the Visitor are invited to report to the Publisher any Content that is contrary to the principles and values listed above, via the reporting links appearing on the Site or by sending an e-mail to imtcollab@imt.fr.
ARTICLE 6 - LIMITATION OF THE EDITOR'S LIABILITY
The information contained on this site is as accurate as possible and the site is periodically updated, but may nevertheless contain inaccuracies, omissions or gaps. If you notice a gap, error or what appears to be a malfunction, please report it by e-mail to imtcollab@imt.fr, describing the problem as precisely as possible (problem page, triggering action, type of computer and browser used, etc.).
Any content downloaded is done so at the user's own risk and under his/her sole responsibility. Consequently, Institut Mines-Télécom cannot be held responsible for any damage to the user's computer or loss of data resulting from downloading.
Institut Mines-Télécom shall not be held liable for any hypertext links set up within the framework of the present website to other resources on the Internet.
ARTICLE 7 - DECLARATION TO CNIL
In accordance with the French Data Protection Act 78-17 of January 6, 1978 (amended by Act 2004-801 of August 6, 2004 on the protection of individuals with regard to the processing of personal data) relating to information technology, files and civil liberties, the site has been declared to the French Data Protection Authority (Commission nationale de l'informatique et des libertés - www.cnil.fr).
ARTICLE 8 - RIGHT OF ACCESS AND CONFIDENTIALITY
In application of this law, Internet users have the right to access, rectify, modify and delete data concerning them personally. This right may be exercised by writing to Institut Mines-Télécom or by sending an e-mail to imtcollab@imt.fr . Under no circumstances will the personal data collected be passed on to third parties.
